The Powai police station has not been constructed by the state government, but from donations of around Rs 31.12 lakh given by five builders, a hotelier, a biotech company, and a bank. This was revealed when the Bombay high court was hearing a petition filed by Dr Alankar Khanwilkar seeking transfer of investigation in an alleged medical negligence case against a doctor of Dr L H.Hiranandani Hospital. The petitioner claimed that the doctor’s negligence had resulted in his mother’s death in 2006.
Dr Khanwilkar had sought the case be transferred from the Powai police to an independent agency, like the state Crime Investigation Department, claiming that the police had not done proper investigation for illegal gratifications received from builders, especially Niranjan Hiranandani.
Counsel for the petitioner, EA Sasi, told the court that a Right to Information (RTI) query had revealed that Lake View Developers, a firm owned by Hiranandani, had contributed Rs 12.65 lakh for construction of the police station. It also revealed that though Rs 24 lakh was spent on the construction, the authorities had collected donations of Rs 31.12 lakh.
The list of donors includes ICICI Bank (Rs 1.23 lakh), K Raheja Group (Rs 3 lakh), Kanakia Builders (Rs 2 lakh), Aakruti Builders (Rs 2 lakh), GHP Builders (Rs 7.13 lakh), Challete Hotel (Rs 2.09 lakh) and Jenam Biotech (Rs 1 lakh).
Sasi pointed out the need to set up an independent medical board to check if there was medical negligence in the death of the petitioner’s mother. The lawyer alleged the medical report relied by the police had been manipulated.
Additional public prosecutor SV Gajare said the charge-sheet had been filed in April 2008.
A division bench of justice AM Khanwilkar and justice AR Joshi Sasi refused to interfere, and granted the petitioner liberty to approach trial court. The bench observed the need to set up an independent medical board would obviously be included in further investigation.
